Cuomo Executive Order Extends the Suspension and Modifications of Healthcare Regulations during COVID-19 Pandemic
As MLMIC keeps policyholders informed about developments related to delivering care during the COVID-19 pandemic, we want to highlight a new update from New York Governor Cuomo. Effective through May 7, an Executive Order issued by the Governor continues certain directives outlined in previous Executive Orders related to COVID-19 issued since March 7.
Physicians are advised to consider the following Executive Order 202.14 provisions that directly impact healthcare and malpractice liability:
- Permits graduating medical students (who have been accepted into a residency program) to immediately begin practicing medicine under the supervision of a licensed physician;
- Continues the suspension and modification of certain healthcare regulations for physicians and other medical professionals rendering medical services in support of the State’s response to the COVID-19 outbreak (View New York State Executive Order 202.10: Immunities Granted to Licensed Healthcare Individuals here);
- Continues tolling of the statute of limitations deadlines for filing civil lawsuits;
- Requires hospitals and any entities with personal protective equipment or respiratory devices to report their inventory of such equipment to the New York State Department of Health (DOH) and authorizes the DOH to shift any such equipment to any health care facility in the state with an urgent need.
