New Albany Report: Significant Expansion of Medical Malpractice Statute of Limitations
Effective January 31, 2018, upon signature from Governor Andrew Cuomo, a new law in New York State represents a significant change to the medical malpractice statute of limitations. To help policyholders understand the impact of the expansion of the statute of limitations, MLMIC has released a new edition of The Albany Report.
In Volume 2, Number 2*, policyholders will find:
- details about the statute of limitations expansion in actions related to negligent failure to diagnose a malignant tumor or cancer;
- an explanation of retroactive clauses included in the new law; and
- a reminder about the current statute of limitations that still applies to all other cases.
In addition to dedicating this edition of The Albany Report to this matter, MLMIC will be offering educational programs across New York State to help policyholders manage the risks and reduce the exposures presented by this new law. Please consult The Albany Report for specifics.
*UPDATE: This edition is no longer live. Please access the most current version of The Albany Report here.
